Two Suits Dismissed with Prejudice
Hunter, Smith & Davis partner, Suzanne S. Cook, recently obtained two dismissals with prejudice in cases where she defended local corporate clients that were being sued for $400,000 and $2,000,000, one in federal court and one in state court. After Ms. Cook took the deposition of the plaintiffs in the respective cases, she filed a Motion for Summary Judgment in each case. Thereafter, based upon the strength of the motions, each plaintiff dismissed his case without any response in writing or oral argument to the court, meaning the suits cannot be refiled.
